1. Acceptance of Terms

By accessing and using eventQR.lk ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

eventQR.lk is operated in Sri Lanka and these Terms of Service are governed by the laws of the Democratic Socialist Republic of Sri Lanka.

2. Description of Service

eventQR.lk provides a digital photo guestbook platform that allows event hosts to:

• Create unique QR codes for their events
• Collect photos and videos from guests through a web-based upload interface
• Manage and moderate uploaded content through an admin gallery
• Access their event gallery for 12 months from the event date
• Download all photos as a ZIP file
• Order printed QR code cards for display at venues (optional add-on service)

Guests can upload photos and videos without creating an account or downloading any mobile application.

3. User Accounts and Registration

To create events and access admin features, you must register for an account by providing:

• A valid email address
• A secure password
• Your name (required)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

4. Event Creation and Management

When creating an event, you agree to:

• Provide accurate and truthful information about your event
• Use the Service only for lawful purposes and in accordance with these Terms
• Not create events that promote illegal activities, hate speech, or harmful content
• Respect the privacy and rights of your guests
• Set appropriate PIN protection for your admin gallery

You are solely responsible for the content uploaded to your events and for ensuring you have the right to collect and store such content.

5. Content Upload and Ownership

Guest Uploads: Guests who upload photos or videos to your event grant you (the event host) a license to use, store, and display such content in connection with your event. Guests retain ownership of their uploaded content.

Host Rights: As an event host, you own or have the right to use all content uploaded to your events. You may download, share, and use this content for personal, non-commercial purposes related to your event.

Prohibited Content: Users must not upload content that:

• Violates any applicable laws or regulations in Sri Lanka
• Infringes upon intellectual property rights of others
• Contains explicit, offensive, or inappropriate material
• Includes personal information of others without consent
• Contains malware, viruses, or harmful code

We reserve the right to remove any content that violates these terms without prior notice.

6. Payment and Pricing

Our Service is offered at a flat rate of Rs. 10,000 per event, payable in Sri Lankan Rupees (LKR). Payment is processed securely through PayHere, a licensed payment gateway in Sri Lanka.

Payment Terms:

• Payment must be completed before your event QR code is activated
• All payments are final and non-refundable, except as required by Sri Lankan consumer protection laws
• Prices are subject to change, but changes will not affect events already paid for
• Additional fees may apply for optional services such as printed QR code cards

If you believe you have been charged incorrectly, please contact us within 30 days of the transaction.

7. Printed QR Code Cards

If you choose to order printed QR code cards:

• You must provide accurate shipping information including name, address, city, state, postal code, country, and phone number
• Delivery times are estimates and may vary based on location within Sri Lanka
• We are not responsible for delays caused by shipping carriers or incorrect shipping information
• Printed cards are custom-made and may not be returnable once production begins
• You are responsible for ensuring the shipping address is correct and accessible

Delivery status will be updated in your account dashboard. Please allow reasonable time for production and shipping.

8. Service Availability and Storage

Gallery Access: Your event gallery remains accessible for 12 months from the event date. After this period, content may be archived or deleted.

Upload Window: Guests can upload photos and videos for 3 months after the event date. After this period, uploads are disabled.

Service Interruptions: We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We are not liable for temporary service interruptions due to maintenance, technical issues, or circumstances beyond our control.

We recommend downloading your photos regularly to ensure you have local copies.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

We comply with applicable data protection laws in Sri Lanka and take reasonable measures to protect your data.

10. Intellectual Property

The Service, including its original content, features, and functionality, is owned by eventQR.lk and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our express written permission.

11. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. However, you may download your content before termination if your account is still active.

You may terminate your account at any time by contacting us. Upon termination, we will delete your account and personal information in accordance with our Privacy Policy, subject to any legal retention requirements.

13. Limitation of Liability

To the maximum extent permitted by applicable law in Sri Lanka, eventQR.lk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless eventQR.lk and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

We encourage you to contact us first to resolve any disputes amicably before pursuing legal action.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
